Australia: virtual asset registration and financial services licensing
Two regulatory assessments
Australian virtual asset service providers must enrol and register with AUSTRAC where their services fall within the registrable perimeter. The 2026 AML/CTF reforms expanded the framework beyond the former digital currency exchange model. New entrants generally need registration approval before operating; the transitional continuation route for certain new services depended on applying before 29 July 2026. That expired application deadline is not a standing exemption for a new business. AUSTRAC registration requirements AUSTRAC transitional rules 2026
AUSTRAC registration addresses financial crime supervision. ASIC separately assesses whether an asset, arrangement or service is a financial product or regulated financial service. Securities, derivatives, managed investment schemes, payment facilities and financial markets can already trigger Corporations Act licensing. An institution must classify the complete arrangement, including custody and client rights, rather than rely on the token’s commercial label. ASIC digital asset guidance
Controls required in 2026
The updated AUSTRAC framework requires an AML/CTF program, customer due diligence, reporting and records appropriate to the services. Obligations for newly regulated virtual asset services, including relevant transfer-information duties, were deferred until 1 July 2026. Existing fiat exchange services had a different transition treatment. A provider should document which services it performs and which transitional provisions it actually qualifies for before deciding which customer and transfer controls apply. For an institutional operating model, the registration and ASIC assessments should feed into the same customer journey: which entity receives funds, who holds assets, which party monitors transfers, and how suspicious activity reaches the reporting function. Registration does not itself establish a safeguarding entitlement or banking relationship. Where the arrangement is a financial product, the applicable ASIC authorisations and client protections must also be implemented. AUSTRAC registration requirements ASIC digital asset guidance
Enacted reform and future commencement
The Corporations Amendment (Digital Assets Framework) Act 2026 received Royal Assent on 8 April 2026 and commences on 9 April 2027. ASIC’s roadmap covers implementation of licensing for digital asset platforms and tokenised custody platforms. The statute has been enacted, but its future commencement and associated implementation work must be distinguished from the financial product requirements already effective today. A platform planning a 2027 launch should assess that forthcoming framework with Australian counsel while meeting its current obligations. ASIC implementation roadmap
